His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Births, Deaths and Marriages Registration Act 1995.

Explanatory note
The object of this Regulation is to prescribe the Births, Deaths and Marriages Registration Act 1996 of the Northern Territory and the Births, Deaths and Marriages Registration Act 1997 of the Australian Capital Territory in relation to interstate recognition certificates for transgender persons. The proposed amendment will enable a person to whom a certificate has been issued under those Acts to be legally recognised in New South Wales as a person of the sex as stated in the certificate.

This Regulation is made under the Births, Deaths and Marriages Registration Act 1995, including sections 32I (Effect of alteration of register and interstate recognition certificates) and 62 (the general regulation-making power).

1      Name of Regulation

2 Amendment of Births, Deaths and Marriages Registration

Regulation 1996

The Births, Deaths and Marriages Registration Regulation 1996 is amended as set out in Schedule 1.
