Part 1—Preliminary

1  Name

This instrument is the Biosecurity (Preventative Biosecurity Measures—Incoming International Flights) Repeal Determination 2022.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsection 51(2) of the Biosecurity Act 2015.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Part 2—Savings

5  Savings

Despite the repeal of the Biosecurity (Preventative Biosecurity Measures—Incoming International Flights) Determination 2022 by Schedule 1 to this instrument, that instrument continues to apply in relation to a relevant international flight (within the meaning of that instrument):

(a)  for which the scheduled departure time is before 12.01 am, by legal time in the Australian Capital Territory, on 9 September 2022; and

(b)  that is scheduled to arrive at a landing place in Australian territory at or after 12.01 am, by legal time in the Australian Capital Territory, on 9 September 2022;

as if that repeal had not happened.

Part 3—Repeal of this instrument

6  Repeal of this instrument

This instrument is repealed at the start of 10 September 2022.
