Biosecurity Act 2015
I, Satendra Kumar, Director Plant Biosecurity and Product Integrity, Department of Primary Industries Biosecurity & Food Safety, Regional NSW, with the delegated authority of the Secretary of Regional NSW in pursuance of section 379 of the Biosecurity Act 2015 and in pursuance of section 404A of the Biosecurity Act 2015 (“the Act”), make the following Order.

Explanatory note
This Order is made under section 404A of the Act and section 43(2) of the Interpretation Act 1987.
The object of this Order is to amend the Biosecurity Order (Permitted Activities) 2019 to—
(a) allow an additional certification scheme for the importation of bananas into NSW,
| (b) | correct temperature and rate specifications for methyl bromide fumigation to manage the risk of Mediterranean fruit fly in host fruit, |
| (c) | provide for harvesting of turf in accordance with APVMA approved chemical label directions and permit conditions, and |
(d) correct a typographical error in relation to whole wine grapes.
This Order should be read in conjunction with the mandatory measures and regulatory measures contained in Part 2 of the Biosecurity Regulation 2017.

1 Name of Order
This Order is the Biosecurity Order (Permitted Activities) Amendment Order 2020.
2 Commencement
This Order commences on the day it is published on the NSW Legislation website.
3 Amendment of the Biosecurity Order (Permitted Activities) 2019
[1] Clause 37(2)
Omit paragraph. Insert instead—
(2) A person may import into the State a banana if the banana is free of soil and
other plant material and the banana is accompanied by an acceptable biosecuritycertificate that certifies the banana is free of soil and other plant material.
[2] Clause 37(6)
Insert after clause 37(5)—
(6) In this clause—
acceptable biosecurity certificate means—
(a) a Plant Health Certificate, or
(b) a Plant Health Assurance Certificate issued in accordance with ICA
scheme procedure ICA-67 ‘Inspection of bananas for freedom of soil andplant material.’
