1  Name

This instrument is the Biosecurity Legislation Amendment (Emergency and Entry Requirements) Determination 2022.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsections 44(2) and 477(1) of the Biosecurity Act 2015.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Biosecurity (Entry Requirements—Human Coronavirus with Pandemic Potential) Determination 2022

1  Subsection 6(6)

Omit “of which of”, insert “of which one of”.

2  Subparagraph 6(6)(a)(i)

After “Administration”, insert “(whether or not the individual has also received a booster dose of an accepted COVID‑19 vaccine)”.

3  Subsections 7(2) to (4)

Repeal the subsections, substitute:

Ability to attest to non‑exposure

(2)  The individual must be able to attest that in the 3 days before the day the relevant international flight was scheduled to commence, the individual had not been exposed, without adequate personal protective precautions, to a person who tested positive for COVID‑19 in that period.

Attesting in writing on request

(3)  The individual must attest to the matter mentioned in subsection (2) in writing if a relevant official asks the individual to do so.

4  Subparagraph 14(2)(d)(i)

Omit “14”, substitute “7”.

5  Subsections 6(2) and (3)

Repeal the subsections.

6  Subsection 6(4) (heading)

Repeal the heading, substitute:

Persons who have received an accepted course of vaccinations

7  Paragraph 6(4)(a)

Omit “an accepted COVID‑19 vaccine in accordance with a schedule for receiving that vaccine”, substitute “one or more accepted COVID‑19 vaccines in accordance with a schedule for receiving that course of vaccinations”.

8  Paragraph 6(4)(a)

After “Administration”, insert “(whether or not the person has also received a booster dose of an accepted COVID‑19 vaccine)”.

Schedule 2—Repeals
