Biosecurity and Agriculture Management Regulations Amendment Regulations 2024

Made by the deputy of the Governor in Executive Council.

Part 1 – Preliminary1.Citation

These regulations are the Biosecurity and Agriculture Management Regulations Amendment Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  Part 1 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on the day after that day.

Part 2 – Biosecurity and Agriculture Management (Aerial Application) Regulations 2018 amended3.Regulations amended

This Part amends the Biosecurity and Agriculture Management (Aerial Application) Regulations 2018.

4.Regulation 5 amended

• (1)

  Before regulation 5(1) insert:

   
• (1A)

  In this regulation —

approved training organisation means —

• (a)

  an NVR registered training organisation as defined in the National Vocational Education and Training Regulator Act 2011 (Commonwealth) section 3; or

• (b)

  a registered training provider as defined in the Vocational Education and Training Act 1996 section 5(1); or

• (c)

  a registered education and training organisation as defined in the Education and Training Reform Act 2006 (Victoria) section 1.1.3(1).

   
• (2)

  In regulation 5(3) delete “a training organisation registered by the Australian Skills Quality Authority (the National VET Regulator) established under the National Vocational Education and Training Regulator Act 2011 (Commonwealth) section 155” and insert:

   

an approved training organisation

Part 3 – Biosecurity and Agriculture Management (Agriculture Standards) Regulations 2013 amended5.Regulations amended

This Part amends the Biosecurity and Agriculture Management (Agriculture Standards) Regulations 2013.

6.Regulation 6 amended

In regulation 6 in the definition of MRL Standard delete “Agricultural and Veterinary Chemicals Code Instrument No. 4 (MRL Standard) 2012 (Commonwealth) clause 5(2), as amended from time to time;” and insert:

Agricultural and Veterinary Chemicals (MRL Standard for Residues of Chemical Products) Instrument 2023 (Commonwealth) clause IV(2);
