Biosecurity and Agriculture Management

Industry Funding Scheme (Grains) Amendment

Regulations 2012

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Biosecurity and Agriculture
Management Industry Funding Scheme (Grains) Amendment
Regulations 2012.

2.             Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Biosecurity and Agriculture
Management Industry Funding Scheme (Grains)
Regulations 2010.

4.             Regulation 3 amended

(1) In regulation 3 in the definition of full participant:

(a) in paragraph (a) delete “18(1)” and insert:

17(1)

(b) in paragraphs (b) and (c) delete “18(1) —” and insert:

(2)	In regulation 3 in the definition of non-participant delete “18(1);” and insert:

(3)	In regulation 3 in the definition of participant delete “18(1);” and insert:

5.             Regulation 21 amended

(1) In regulation 21(1):

(a) in paragraph (b) delete “pest.” and insert —

pest; or

(b)	after paragraph (b) insert:
(c) as a result of actions or measures taken under an approved programme.

(2)	Delete regulation 21(2) and insert:
(2) No payment shall be made under subregulation (1) in respect of any indirect, incidental or consequential loss, but only in respect of losses arising directly from —

(a)	infection or infestation with a specified pest; or
(b)	actions or measures taken to control a specified pest; or
(c)	actions or measures taken under an approved programme.

6.             Regulation 28 amended

In regulation 28(2)(b)(ii) delete “who” and insert:
