Biosecurity and Agriculture Management

(Declared Pest Account) Amendment

Regulations 2019

Made by the Governor in Executive Council.

1.      Citation

These regulations are the Biosecurity and Agriculture
Management (Declared Pest Account) Amendment
Regulations 2019.

2.     Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2— on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.      Regulations amended

These regulations amend the Biosecurity and Agriculture Management (Declared Pest Account) Regulations 2014.

4.      Regulation 4 amended

Delete regulation 4(2)(b) and insert:

(b) in so far as is reasonably practicable, give a copy of the notice to each owner of affected land if —

(i)the Minister has not made a

determination in relation to the rate
chargeable on the affected land for the
previous financial year; or

(ii) the rate the Minister proposes to

determine is an increase of 5% or more
on the rate determined in respect of the
affected land in the previous financial
year.
