Biological Control Amendment Act 2016

No. 39 of 2016

An Act to amend the Biological Control Act 1986.

[Assented to 22 November 2016]

The Parliament of Western Australia enacts as follows:

1.Short title

This is the Biological Control Amendment Act 2016.

2.Commencement

This Act comes into operation as follows —

  • (a)

    sections 1 and 2 — on the day on which this Act receives the Royal Assent;

  • (b)

    the rest of the Act — on a day fixed by proclamation.

3.Act amended

This Act amends the Biological Control Act 1986.

4.Section 3 amended
  • (1)

    In section 3(1) delete the definition of prescribed live organisms.

  • (2)

    In section 3(1) insert in alphabetical order:

     

prescribed organisms —

  • (a)

    means organisms that are —

  • (i)

    live organisms; or

  • (ii)

    viruses or sub‑viral agents;

but

  • (b)

    does not include live vaccines or resistant cultivars;

     
  • (3)

    In section 3(1) in the definition of kind after “organisms,” insert:

     

viruses or sub‑viral agents,

  • (4)

    In section 3(1) in the definition of organism —

    • (a)

      in paragraph (b) delete “paragraph (a);” and insert:

       

    paragraph (a); or

     
    • (b)

      after paragraph (b) insert:

       
    • (c)

      a virus or a sub‑viral agent;

       
    5.Section 4 amended

In section 4 delete “live” and insert:

prescribed

6.Part 9 inserted

After section 59 insert:

Part 9    Transitional provision for Biological Control Amendment Act 2016

60. Transitional provision for declaration of relevant laws

  • (1)

    In this section —

commencement day means the day on which the Biological Control Amendment Act 2016 section 6 comes into operation;

existing declaration means a declaration made under section 5 and in effect immediately before the commencement day.

  • (2)

    An existing declaration continues in effect and may be dealt with on and after the commencement day despite the amendments made by the Biological Control Amendment Act 2016.

     
7.References to prescribed live organisms amended

In the provisions listed in the Table delete “live”.
