An Act to amend the Biological Control Act 1984, and for related purposes

The Parliament of Australia enacts:

1Short title

This Act may be cited as the Biological Control Amendment Act 2016.

2Commencement

1. (1)

   Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3Schedules

Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendments

Biological Control Act 1984

Subsection 2(1) (definition of kind)

After “organisms”, insert “, viruses or sub‑viral agents”.

Subsection 2(1) (at the end of the definition of organism)

Add:

1. ; or (c)

   a virus or a sub‑viral agent.

Subsection 2(1) (definition of prescribed live organisms)

Repeal the definition.

Subsection 2(1)

Insert:

prescribed organisms means organisms that are:

1. (a)

   live organisms; or

2. (b)

   viruses or sub‑viral agents;

but does not include live vaccines or resistant cultivars.

Section 3

Omit “live”, substitute “prescribed”.

Subsections 21(1), 22(1) and 26(1)

Omit “live”.

Paragraphs 30(1)(b), 31(1)(a) and 34(2)(a)

Omit “live”.

Subsection 37(3)

Omit “live”.

Declarations of relevant State laws

If:

1. (a)

   a declaration was made under section 9 of the Biological Control Act 1984 before the commencement of this item; and

2. (b)

   the declaration was in effect immediately before that commencement;

the declaration continues in effect (and may be dealt with), after that commencement, despite the amendments made by this Schedule.
