BIOLOGICAL CONTROL AMENDMENT ACT 1996

AN ACT to amend the Biological Control Act 1986.

[Assented to 28 June 1996.]

The Parliament of Western Australia enacts as follows:

Short title

1.   This Act may be cited as the Biological Control Amendment

Act 1996.

Commencement

2. This Act comes into operation on the day on which it

receives the Royal Assent.

Principal Act

3.   In this Act the Biological Control Act 1986* is referred to as

the principal Act.

Section 3 amended

4.   Section 3 (1) of the principal Act is amended —

(a)

by deleting the definition of ‘‘Council’’ and substituting the following definition —

‘‘

‘‘Council’’ means —

(a)

subjecttoparagraph(b),the Agriculture and Resource Management Counc i l o f Australia and New Zealand, whether known by that or any other name; or

(b)

if another body is prescribed by regulations for the purposes of this definition, that other body;

’’;

(b)

inthedefinitionof‘‘State’’byinserting,after ‘‘Territory’’, the following —

‘‘

and the Australian Capital Territory

’’; and

(c)

inthedefinitionof‘‘Territory’’byinserting,after ‘‘Northern Territory’’, the following —

‘‘

or the Australian Capital Territory

’’.

Section 15 amended

5.   Section 15 (2) of the principal Act is amended by deleting

‘‘and the Australian Capital Territory’’.

Sections 17, 26 and 31 amended

6.   Sections 17 (1) (f), 26 (1) (f) and 31 (1) (d) of the principal

Act are amended —

(a)

bydeleting‘‘IndustriesAssistanceCommissionAct 1973’’ and substituting the following —

‘‘

Industry Commission Act 1989

’’; and

(b)

bydeleting‘‘IndustriesAssistanceCommission’’and substituting the following —

‘‘ Industry Commission ’’.
