Biofuels Amendment (E10) Regulation

Her Excellency the Governor, with the advice of the Executive Council, and on the recommendation of the Minister for Lands, has made the following Regulation under the Biofuels Act 2007.

Explanatory note
The object of this Regulation is to prescribe a later start date from which a primary wholesaler will be prohibited from selling regular unleaded petrol, unless the petrol is E10 (as defined in the Biofuels Act 2007). The prohibition was scheduled to take effect on 1 July 2011 but will now take effect on 1 July 2012.

This Regulation is made under the Biofuels Act 2007, including sections 8 and 30 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Biofuels Amendment (E10) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Biofuels Regulation 2007

Clause 4A

Insert after clause 4:

4A Regular unleaded petrol to be E10—later start date

For the purposes of section 8 of the Act, 1 July 2012 is prescribed as the start date on which that section takes effect.
