Bills of Sale Regulations 2009

under the Bills of Sale Act 1886

1Short title

These regulations may be cited as the Bills of Sale Regulations 2009.

3Interpretation

In these regulations, unless the contrary intention appears—

Act means the Bills of Sale Act 1886.

5Requirements relating to paper used for bills of sale etc

The following requirements are prescribed under section 38A of the Act in relation to the paper on which bills of sale and other instruments lodged with the Registrar for registration or filing under that Act are written:

  1. (a)

    the paper must be A4 size (210 millimetres in width and 297 millimetres in length);

  2. (b)

    the weight of the paper must be at least 80 grams per square metre;

  3. (c)

    the paper must be white in colour and not be discoloured or have any other defect.

6Application of Act to certain bills of sale as if certain amendments not made
  1. (1)

    Pursuant to section 47(2) of the Act, the Act applies until 30 June 2022 to a bill of sale over a licence issued under the Natural Resources Management Act 2004 as if the amendments made to the Act by the Statutes Amendment (Personal Property Securities) Act 2011 (the amending Act) (other than the amendments specified in subregulation (2)) had not been made.

  2. (2)

    For the purposes of subregulation (1), the following amendments are specified:

    1. (a)

      the amendments made to section 2 of the Act by section 5 of the amending Act;

    2. (b)

      the insertion of sections 43 to 48 (inclusive) of the Act by section 17 of the amending Act.

  3. (3)

    Pursuant to section 47(2) of the Act, the Act applies to a bill of sale registered under the Act before 30 January 2012—

    1. (a)

      over a licence issued under the Aquaculture Act 2001 or the Fisheries Management Act 2007; or

    2. (b)

      over an interest in irrigation rights fixed by a trust,

as if the amendments made to the Act by the amending Act (other than the amendments specified in subregulation (4)) had not been made until the bill of sale expires or is discharged.

  1. (4)

    For the purposes of subregulation (3), the following amendments are specified:

    1. (a)

      the amendments made to section 2 of the Act by section 5 of the amending Act;

    2. (b)

      the amendment made to section 19A of the Act by section 13 of the amending Act;

    3. (c)

      the insertion of section 42(1)(d) and (e) of the Act by section 17 of the amending Act;

    4. (d)

      the insertion of sections 43 to 48 (inclusive) of the Act by section 17 of the amending Act.
