AN ACT to authorise the Discontinuance of the Bibra Lake-Armadale Railway and to Revest in Her Majesty portion of the land comprised therein.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

This Act may be cited as the Bibra Lake-

Armadale Railway Discontinuance and Land Revest-

ment Act, 1964.

This Act shall come into operation on a date to be fixed by proclamation.

Interpreta-

tion. 3. In this Act, unless the contrary intention

appears

"scheduled railway" means the railway described in the First Schedule to this Act.

Discon-

tinuance of	4. On and from the date of the coming into

(b)	be used in the making of any railway for Her Majesty in the State that is made under the authority of a special Act as required by section ninety-six of the Public Works Act, 1902, whether the making of the railway is so authorised before or after the coming into operation of this Act; or
(c)

be sold, disposed of, or otherwise dealt with. (2) A direction given by the Minister pursuant to this section has, and shall be given effect, according to its tenor.

THE FIRST SCHEDULE.

Description of Bibra Lake-Armadale Railway. S. 3.

Commencing at a point 19 miles 25 chains 30 links from Perth via Fremantle on the Bibra Lake-Armadale Railway and proceeding easterly for about 22 chains, thence south- easterly for about 52 chains thence east by south-east for about 3 miles 27 chains thence easterly for about 20 chains thence south easterly for about 2 miles 1 chain thence east- erly for 5 miles 20 chains thence south easterly for about 18 chains and terminating at a point 31 miles 30 chains 90 links from Perth via Fremantle on the Bibra Lake- Armadale Railway, a total length of 12 miles 5 chains 60 links, being part of the railway line authorised to be constructed pursuant to the Jandakot Railway Act, 1904 (3 Edward VII No. 17) and the whole of the railway line authorised to be constructed pursuant to the Jandakot- Armadale Railway Act, 1906 (6 Edward VII No. 25).

The portion of land commencing at a point 11 chains 50 links west of the Common boundary of Cockburn Locations Nos. 334 and 541 and finishing at the western alignment of Railway Parade Armadale L.T.O. Plan 2921.
