1. This amended application for special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Victoria (McLeish, T Forrest and Kennedy JJA) is not a suitable vehicle to examine the question of law raised by the applicant. An appeal to this Court would have insufficient prospects of success to warrant the grant of special leave to appeal. The application should be dismissed.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
