BETTING (OFF-COURSE TOTALIZATOR AGENCY)

No. 13 of 1968

An Ordinance to amend the Betting (Off-course Totalizator

Agency) Ordinance 1964-1966.

1.—(1.) This Ordinance may be cited as the Betting (Off-course

Totalizator Agency) Ordinance 1968.*

(2.) The Betting (Off-course Totalizator Agency) Ordinance

1964-1966f is in this Ordinance referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordinance, may

be cited as the Betting (Off-course Totalizator Agency) Ordinance
1964-1968.

2. The title of the Principal Ordinance is amended by inserting after

the word " Horse " the words " or Dog ".

3.   Section 4 of the Principal Ordinance is amended— (a) by omitting the definition of " licensed racecourse "; and

(b) by inserting in the definition of " r a c e " , after the words

" horse race,", the words " dog race,".

4 . Section 20 of the Principal Ordinance is amended by omitting

from paragraph (c) of sub-section (2.) the word " l icensed".

5.   Section 23 of the Principal Ordinance is amended—

(a) by inserting at the end of paragraph (b) of sub-section
(1.) the word " a n d " ;
(b) by omitting from paragraph (c) of that sub-section the

word " a n d " (last occurring);

(c) by omitting paragraph (d) of that sub-section;

(d) by omitting sub-section (2.) and inserting in its stead the

following sub-section:—

" (2.) The last preceding sub-section does not apply to information given by telephone in reply to an inquiry made by telephone."; and

(e) by adding at the end thereof the following sub-sections:—

" (4.) A person having the management or control of

an office or agency of the Board may—

(a)

request a person who is drunk, violent, quarrel­ some, behaving in a disorderly manner, or loiter­ ing or hanging about in the office or agency, to leave the office or agency; and

(b)

refuse to admit such a person to the office or agency.

" (5.) A person shall not—

(a)

enter an office or agency of the Board on being refused admittance to it under the last preceding sub-section; or

(b)

refuse or fail to leave an office or agency of the Board on being requested to leave it under that sub-section.".

6. Section 24 of the Principal Ordinance is amended by omitting

i word " licensed ".

7.   Section 36 of the Principal Ordinance is amended— (a) by omitting the word " l icensed" (wherever occurring);

(b)

by omitting paragraph (b) of sub-section (2.) and insert­ " (b) in respect of a race outside the Territory—

(i)   on the totalizator at a racecourse in the Ter­ ritory; or

(ii)   on the totalizator at a racecourse in a State or another Territory of the Commonwealth, being the totalizator in respect of which a body conducting off-course totalizator betting in that State or Territory on that race is the agent, in pursuance of an agreement with that body under section twenty of this Ordinance."; and

(c) by inserting in sub-section (3.), after the words " a race ", the words " for placement on the totalizator ".

8.   Section 41 of the Principal Ordinance is amended—

(a) by omitting sub-sections (3 . ) , (5.) and ( 6 . ) ; and

(b)

by omitting from sub-section (7.) the words "conviction to " and inserting in their stead the words " conviction by ".

9.   Section 44 of the Principal Ordinance is amended—

(a) by inserting in sub-section (1.) after the word " B o a r d " , the words " and totalizators on racecourses to which bets are transmitted by the Board "; and
(b) by adding at the end of sub-section (5.) the words "for
