BETTING CONTROL (BUNBURY
GOLDEN CLASSIC) ACT
No. 80 of 1986
AN ACT to permit betting on the foot-races known as the "Bunbury Golden Classic" and for incidental and other purposes.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
Short title
1. This Act may be cited as the Betting Control (Bunbury Golden
Classic) Act 1986.

Commencement
2. This Act shall come into operation on the day on which it receives
the Royal Assent.
Interpretation
3. In this Act unless the contrary intention appears-
"Bunbury Golden Classic" means the foot-race known as the Bunbury Golden Classic and any foot-races held for the purposes of qualifying for that foot-race to be held at the place at Bunbury and on the days in the year 1987 appointed by the Minister under section 4;
"licensed bookmaker" means a person holding a licence as defined in
section 4 of the Betting Control Act 1954;
"the appointed place" means the place appointed by the Minister
under section 4.
Days and place to be notified
4. (1) The Minister may by notice published in the Government
Gazette appoint the days in the year 1987 on which and the place at
which the Bunbury Golden Classic shall be conducted by the body known
as the Bunbury Chamber of Commerce Inc.
(2) The Minister may by notice published in the Government Gazette
revoke or amend a notice published under subsection (1).
Betting on Bunbury Golden Classic to be lawful
5.
(1) Notwithstanding any law to the contrary but subject to this Act, a person may lawfully bet with a licensed bookmaker by way of wagering or gaming on the Bunbury Golden Classic at the appointed place as though
| (a) | the Bunbury Golden Classic were a race; |
| (b) | the appointed place a race course; and |
| (c) | the body known as the Bunbury Chamber of Commerce Inc. |

as defined under section 4 of the Betting Control Act 1954 and his doing so does not of itself constitute a contravention of the law and is not a ground for the appointed place being licensed or declared to be, or to be used as, a common betting house or a common gaming house or to be a common nuisance contrary to the law.
(2) Subject to this section, the Betting Control Act 1954 with such modifications as are necessary for the purpose of giving effect to subsection (1) applies to and in relation to the making of bets with licensed bookmakers on the Bunbury Golden Classic at the appointed place.
(3) Sections 12 (2a), (2b) and (2c), 23 and 27 of the Betting Control Act 1954 do not apply to or in relation to the appointed place while the Bunbury Golden Classic is being held at that place.
Totalisator Agency Board Betting Act 1960
Notwithstanding anything in this Act or in the Totalisator Agency Board Betting Act 1960, the Bunbury Golden Classic is not a race on which bets may be made under the Totalisator Agency Board Betting Act 1960.

Regulations
The Governor may make regulations for or with respect to any matter that is necessary or convenient for the purposes of carrying out or giving effect to this Act and may make regulations amending the regulations made under any other Act for the purpose of dealing with matters that are incidental to or consequential upon the provisions of this Act.

Duration of Act
(1) The Act shall continue in operation until 30 June 1987 and no (2) The expiry of this Act shall not affect the previous operation thereof or the validity of action taken under this Act or affect any payment made or to be made in consequence of this Act.
