BERMAGUI HARBOUR WORKS ACT.
Act No. 10, 1959.
An Act to sanction and to provide for the carrying out of works for the Bermagui Harbour; to validate certain matters; and for purposes connected therewith. [Assented to, 1st October, 1959.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows : — 1. (1) This Act may be cited as the "Bermagui Harbour
Works Act, 1959".
(2) This Act shall be deemed to have commenced upon the first day of May, one thousand nine hundred and fifty-eight.
2. (1) (a) The carrying out of the work described in the Schedule to this Act is hereby sanctioned.
(b) The said work shall be deemed to be an authorised work within the meaning of the Public Works Act, 1912, as amended by subsequent Acts.
(d) The provisions of the Public Works Act, 1912, as amended by subsequent Acts, sections thirty-four, thirty-five, thirty-six and thirty-seven excepted, shall apply to and in respect of the said work. (2) (c) The Minister for Public Works is empowered to carry out the said work and shall be the constructing authority for the same within the meaning of the said Act, as so amended, and shall enter into such contracts and take all such necessary steps for the proper execution thereof as such authority may think proper.
(2) Without prejudice to the generality of subsection one of this section the provisions of section thirty-eight of the Public Works Act, 1912, as amended by subsequent Acts, shall apply to and in respect of any contracts referred to in paragraph (c) of subsection one of this section.
The plan of the said work is the plan marked "Bermagui Harbour Works" signed by the Minister for Public Works and countersigned by the Director of Public Works and deposited in the public office of the said Minister.

4. The cost of carrying out the said work (exclusive of land resumptions) is estimated at two hundred and thirty thousand pounds and such estimated cost shall not, under any circumstances, be exceeded by more than ten per centum.
SCHEDULE.
Works for the Bermagui Harbour comprising: —
(1) The construction of a breakwater on the western side of the Bermagui River entrance and extending in a northerly direction a distance of seven hundred and eighty feet from the existing foreshore.
(2) The construction of a training wall on the eastern side of the river entrance having a length of six hundred and fifty feet.
(3) The construction of two training walls one on either side of the river channel near the entrance, that on the northern side of the channel having a length of five hundred and sixty feet and that on the southern side a length of six hundred and sixty feet.
(4) The dredging of an area in the anchorage basin to a depth of eight feet below Indian Spring Low Water, disposal of dredged material on Crown lands to the east and west of the basin and the construction of reclamation walls for the retention of this material. (5) Other incidental works as deemed necessary or desirable by the Constructing Authority.
The whole of the works hereinbefore described to be subject to such modifications as may be deemed necessary or desirable by the constructing authority.
