This application for special leave to appeal does not raise any issue of principle that would warrant the grant of special leave to appeal. In addition, having regard to the concurrent findings of fact of the courts below, the appeal foreshadowed by the application does not enjoy any real prospect of success. The application should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth) we direct the Registrar to draw up, sign and seal an order dismissing the application and ordering that the applicant pay the costs of the first respondent.
