Bellingen Local Environmental Plan 2003 (Amendment

No 9)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Bellingen Local Environmental Plan 2003 (Amendment

No 9).

2      Aims of plan

This plan aims to amend Bellingen Local Environmental Plan 2003 (the 2003 plan) to permit, with the consent of Bellingen Shire Council, the erection of a dwelling-house:

(a)

on land within Zone No 1 (c1) (the Rural Residential Zone), Zone No 1 (c2) (the Rural Small Holdings Zone) or Zone No 1 (c3) (the Rural Settlement Zone), but only if the land has an area of not less than 4,000 square metres, and

(b)

on a certain parcel of land within Zone No 1 (c2) that has an area less than 4,000 square metres.

3      Land to which plan applies

(1)

In respect of the aim referred to in clause 2 (a), this plan applies to land

within Zones Nos 1 (c1), 1 (c2) and 1 (c3) under the 2003 plan.

(2)

In respect of the aim referred to in clause 2 (b), this plan applies to Lot

1, DP 544591, and known as 179 Old Pacific Highway, Raleigh.

4 Amendment of Bellingen Local Environmental Plan 2003

Bellingen Local Environmental Plan 2003 is amended as set out in

Schedule 1.
