MR BEHRENDS: Your Honours, this is an application for special leave to appeal and I rely here on my application book and I set out all the arguments for this application on pages 83 to 94 and in reply from pages 101 to the end. At that stage I have no further addition and that is all what I have to say in this matter at this stage.

We have, before coming into Court, Mr Behrends, read all your submissions in this matter and we are of the view that your proposed appeal does not enjoy sufficient prospects of ultimate success to justify the grant of special leave. Accordingly, special leave is refused.
