under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Bega Valley Local Environmental Plan 2002 (Amendment

No 5).

2      Aims of plan

This plan aims to amend Bega Valley Local Environmental Plan 2002

so as:

(a)	to rezone part of the land to which this plan applies to partly Zone 3 (a) (General Business Zone) and partly Zone 6 (a) (Existing Open Space Zone), and
(b)	to reclassify part of the land from community land to operational land within the meaning of the Local Government Act 1993.

3      Land to which plan applies

(1)	In respect of the aim referred to in clause 2 (a), this plan applies to certain land bounded by Upper, Auckland, Carp and Gipps Streets, Bega, as shown edged heavy black and lettered “3 (a)” or “6 (a)” on Sheet 1 of the map marked “Bega Valley Local Environmental Plan 2002 (Amendment No 5)” (the amending map) deposited in the office of Bega Valley Shire Council.
(2)	In respect of the aim referred to in clause 2 (b), this plan applies to Lots 32 and 33, DP 844252, Lot 4, DP 215471 and Lot 9, Section 39, DP 758076, Zingel Place, Bega, as shown edged heavy black on Sheet 2 of the amending map.
(3)	This plan does not apply to Lots 10–14, Section 39, DP 758076, Gipps Street, Bega, as shown edged heavy black and lettered “Deferred Matter” on Sheet 1 of the amending map.
