MR K.A. CHAPPLE:   May it please the Court, I appear for the respondent.  (instructed by the Commonwealth Director of Public Prosecutions)

GAUDRON J:   Yes, we need not trouble you, Mr Chapple.

The applicant, who relies on his written submissions, seeks special leave to appeal from the sentence imposed on him by the Court of Criminal Appeal of New South Wales on 24 November 1995. 

By his application, he seeks to have this Court review his sentence on a basis of assistance subsequently provided by him to the National Crime Authority.  That is not a matter that could have been taken into account by the Court of Appeal and there is thus no basis for the grant of special leave.   The application is refused.

MR CHAPPLE:    May it please the Court.

GAUDRON J:   The Court will now adjourn to reconstitute.
