AN ACT to amend the Bee Industry Compensation
Act 1953-1972.
[Assented to 12 November 1980.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—
| 1. (1) This Act may be cited as the Bee Industry Compensation Amendment Act 1980. | Short title |

In this Act the Bee Industry Compensation Act 1953-1972 is referred to as the principal Act.
(2)
The principal Act as amended by this Act may
be cited as the Bee Industry Compensation Act
1953-1980.

Commence-
| ment. | 2. This Act shall come into operation on such |
day or days as is or are fixed by proclamation.
Section 3
amended 3. Section 3 of the principal Act is amended by
deleting "Bees Act, 1930" where occurring in each
case in
(a) the definition "beekeeper"; and
(b) the definition "officer",
and substituting the following-
" Beekeepers Act 1963 ".
Section 4
| amended. | 4. Section 4 of the principal Act is amended |
(a) in subsection (2)-
(i) by deleting "three" in line one and substituting the following-
" four "; and
(ii) by deleting "two" in line five and substituting the following-
" three ";
| (b) | by inserting after subsection (2) the follow- ing subsections- |
" (2a) The term of office of each representative member holding office on the day immediately preceding the date of the coming into operation of section 4 of the Bee Industry Compensation
Amendment Act 1980 is hereby
terminated on that day but any such representative member is eligible for re- appointment.
(2b) Each representative member shall hold office for such period, not exceeding three years, as is specified in the instrument of his appointment and is eligible for re-appointment.

| (c) | in subsection (4), by deleting "two" in line four and substituting the following- |
" three "; and
| (d) | by repealing subsection (8) and sub- stituting the following- |
" (8) Each representative member shall be paid out of the Compensation Fund such fees and allowances as may be determined by the Minister. ".
5. Sections 9 and 10 of the principal Act are andio0"9

" 9. (1) There shall be payable in respect of =ear
every colony of bees owned by a person a licence
fee fixed in accordance with section 10 of this
Act.
(2) The licence fee imposed by subsection (1) of this section shall be paid to the Department at the time that a person applies to be registered as a beekeeper pursuant to the Bee- keepers Act 1963 and whenever application is made for the renewal of such registration.

"commenced registration period" means the period of five years that commenced on 1 January 1978;
"registration period" means the period
commencing on 1 January 1983 and on
every second anniversary of that date.
The amount of the licence fee payable in respect of the commenced registration period shall be 20 cents for each colony of bees owned by a beekeeper and in any event the minimum licence fee payable is $1.

(3) The Minister shall, in respect of a
registration period, other than the commenced
registration period, on the recommendation of

the Committee, by order published in the Government Gazette fix the amount, including a minimum amount, to be paid as a licence fee pursuant to section 9 of this Act. "
Section 11

| amended. |
(a) in subsection (1)—
(i) by deleting "honey," in line three and substituting the following-
" hive products, ";
(ii) by deleting "section ten of the Bees Act, 1930" in the penultimate and last lines and substituting the following-
" section 16 of the Beekeepers
Act 1963 "; and
(b) in subsection (2)-
(i) by deleting "Bees Act, 1930" in the last line of paragraph (b) and sub- stituting the following-
" Beekeepers Act 1963 ";
(ii) by deleting "and" after paragraph (b); and
(iii) by inserting the following-
Cl (ba) where the beekeeper has
used a substance pre- scribed as a prescribed substance pursuant to section 15A of the Bee- keepers Act 1963 contrary to the provisions of that section; and ".

8. Section 13 of the principal Act is amended in ,?,=,13.
subsection (2) by deleting "section ten of the Bees Act, 1930" in lines one and two and substituting the following-
" section 16 of the Beekeepers Act 1963 ".

subsection (1) by deleting "fifty dollars" in para-
graph (d) and substituting the following-
