This application for special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Queensland (Bond and Morrison JJA agreeing, McMurdo JA dissenting) dismissing an application for leave to appeal against the sentence imposed on the applicant by the Supreme Court of Queensland (Applegarth J) requires an extension of time. The proposed appeal is not a suitable vehicle to consider the correctness of the decision in R v Nagy [2004] 1 Qd R 63. Accordingly, it would be futile to grant an extension of time.
Special leave to appeal is refused.
