1      Name of Plan

This Plan is Bathurst Regional (Interim) Local Environmental Plan

2005 (Amendment No 2).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land situated in the Bathurst Regional local government area, being land in DP 270159, known as the Mount Haven Estate, Meadow Flat, as shown edged heavy black on the map marked “Bathurst Regional (Interim) Local Environmental Plan 2005 (Amendment No 2)” deposited in the office of the Bathurst Regional Council.

[1]      Clause 4 Relationship with other environmental planning instruments

Insert “Shire of” before “Evans” in clause 4 (1) (b).

[2]      Clause 31 Subdivision of land in DP 270159, Mount Haven Estate, Meadow Flat

Omit clause 31 (1). Insert instead:

This clause applies to land in DP 270159, known as the Mount Haven Estate, Meadow Flat, being land partly in Zone No 1 (e) and partly in Zone No 1 (f), as shown edged heavy black on the map marked “Bathurst Regional (Interim) Local Environmental Plan 2005 (Amendment No 2)”.

[3]      Clause 31 (5)

Omit “must not consent to an application for consent to erect a dwelling-house on a lot created in accordance with subclause (2) (c) or (d)”.

Insert instead:

must not consent to an application for consent to erect a

dwelling-house:

(a)

on a lot created in accordance with subclause (2) (c) or (d), or

(b)

on land shown hatched on the map marked “Bathurst Regional (Interim) Local Environmental Plan 2005 (Amendment No 2)”

Insert after clause 31 (5):

(6)

The provisions of State Environmental Planning Policy No 1— Development Standards do not apply to the land to which this clause applies.
