WH E R E A S hundred and s ixty- two acres more or less and s i tua te wi th in

cer ta in l and conta in ing by admeasuremen t seven

t h e Borough of B a t h u r s t was by not ice in the Government Gazette

dated t he t en th of J a n u a r y one thousand e ight hundred and sixty-five dedicated for Commonage and publ ic recreat ion a t B a t h u r s t and known as t he P a r k A n d whereas by a notification in t h e said Gazette dated t h e seventh day of November one thousand e ight hund red and seventy- one t h e Council of t he said Borough were appointed Trustees of t h e said Common A n d whereas it is expedient t h a t sale-yards for t he sale of Cat t le should be established on a por t ion of the said l and and i t is necessary t h a t t he said Counci l should for t he purpose of hold ing such sales be empowered to erect and ma in t a in suitable bui ld ings and yards on t h e piece or parcel of land in t h e Schedule to th i s A c t described

a n d set forth be ing a por t ion of t h e said Common Be i t therefore

enacted by t h e Queen ' s Mos t Exce l l en t Majesty by and wi th t h e advice and consent of t he Legislat ive Counci l and Legis la t ive Assembly of N e w South Wales in Pa r l i amen t assembled and by the au thor i ty of the same as follows :—

1. I n t he const ruct ion a n d for t he purposes of th is A c t —

The word " C a t t l e " shall inc lude all horses oxen bul ls cows ho rned

cat t le calves sheep l ambs pigs and goats .

The word " O w n e r " shall inc lude any agent or other person authorized by t h e owner of any cat t le or any person in charge

thereof.

The word " S a l e - y a r d " shall include a n y premises whe re cat t le

are cus tomari ly exhibi ted or kep t for t he purpose of sale

exchange or other disposal whatever .

The word " C o u n c i l " shall m e a n the Borough Counci l of Ba thurs t .

2. I t shall be lawful for t h e Council for t he purpose of m a k i n g

provision for t he sale of ca t t le to erect and ma in t a in sui table bui ld ings yards and o ther premises upon the land in t h e Schedule to this A c t described.

S C H E D U E E .

3. So soon as such sale-yards shall be established and by-laws shall be m a d e a n d confirmed as provided for by t he " Munic ipal i t ies A c t of 1867 " i t shall be lawful for t h e said Counci l to t ake a n d demand from the owner of every head of ca t t le b rough t to any sale- yards established under th i s A c t or yarded or b r o u g h t to any sale-yard or premises wi th in t he Borough of B a t h u r s t w h e t h e r t he same be in tended for sale by publ ic auc t ion or p r iva te con t rac t and whe ther t h e same be in tended for s laughter or otherwise t he fees or charges provided for by the said by-laws Provided t h a t t he fees or charges levied upon cat t le yarded or b rough t to o ther sale-yards shall n o t exceed t h e fees or charges levied upon cat t le yarded or b r o u g h t to sale-yards established unde r th is Ac t .

4. This A c t shall come in to operat ion immedia te ly upon passing

and may be cited as t he " B a t h u r s t Cat t le Sale Yards A c t of 1 8 7 3 . "

SCHEDULE.

Description of ten acres of land portion of seven hundred and sixty-two acres dedicated for Commonage and public recreation at Bathurst and known as the Park measured as a site for cattle sale yards Ten acres of land Commencing at a point bearing two hundred and forty degrees forty minutes distant twenty-one chains forty-one links from the southern corner of section number one hundred and twenty-four in the town of Bathurst and bounded thence on the north by a line west one thousand links on the west by a line south one thousand links on the south by a line east one thousand links on the east by a line bearing norih one thousand links to the point of commence- ment.
