By-laws under the Batchelor Institute of Indigenous Tertiary Education Act 1999

1Citation

These By-laws may be cited as the Batchelor Institute of Indigenous Tertiary Education (Staff) By-laws 2001.

2Terms and conditions of employment

The Council may determine terms and conditions of employment of staff of the Institute in relation to:

  • (a)

    appointment, promotion and dismissal;

  • (b)

    salary progression;

  • (c)

    paid and unpaid leave;

  • (d)

    entitlement to, and payment of, allowances;

  • (e)

    recruitment and transfer expenses;

  • (f)

    conditions applying to employees in remote locations; and

  • (g)

    other matters pertaining to employment.

3Rules pertaining to members of staff

The Council may make rules in accordance with the Batchelor Institute of Indigenous Tertiary Education (Rules) By-laws 2000 in relation to:

  • (a)

    matters relating to staff discipline and disciplinary procedures;

  • (b)

    paid employment additional to duties as a member of the staff of the Institute;

  • (c)

    membership of prescribed employee organisations; and

  • (d)

    other matters pertaining to members of staff and necessary for the carrying into effect of the Act or By-laws.

4No conflict with other laws

Terms and conditions that are set under these By-laws, or rules that are made under the Batchelor Institute of Indigenous Tertiary Education (Rules) By-laws 2000 for the purposes of these By-laws, are ineffective to the extent of any inconsistency with employee awards or enterprise bargaining agreements by which the Institute is bound or with any industrial relations legislation in force in the Territory.
