1 Name

This Determination may be cited as the Bass Strait Central Zone Scallop Fishery (Closure) Direction 2018.

2 Commencement

This instrument commences on the day after it is registered on the Federal Register of Legislation.

3 Cessation

This Direction ceases to have effect as if it was repealed on 1 January 2019. 

4 Authority

This instrument is made pursuant to subsection 41A(2) of the Fisheries Management Act 1991.

5 Definitions

Terms used in this Direction that are defined for the purposes of the Bass Strait Central Zone Scallop Fishery Management Plan 2002 (the Plan) have the same meanings in this Direction as they have in the Plan.

Note:          Terms defined in the Fisheries Management Act 1991 have the same meanings in this Direction.

6 To whom this Direction applies

This Direction applies to a holder of a fishing concession in the Bass Strait Central Zone Scallop Fishery and to a person acting on behalf of the holder.

Note:           This means that the Direction does not apply to a person if the person is fishing in the area of the Fishery in accordance with a fishing concession that is subject to another plan of management in force under the Act, under a scientific permit, a permit issued in another fishery, or under a licence issued under a law of a State or Territory.

7 Direction not to engage in fishing

Fishing is not to be engaged in in the areas described in Schedules 1, 2, 3, 4 and 5.

Flinders Island Beds 1-4

1 The area of the Flinders Island Beds 1-4 is the part of the Australian Fishing Zone contained within and bounded by a line commencing at the point of intersection of latitude 148°03′00ʺS, longitude 39°11ʹ24ʺE and running progressively
2 then south along that meridian to its intersection with the parallel of latitude 39°19ʹ48ʺS
3 east along that parallel to its intersection with the meridian of longitude 148°07ʹ48ʺE
4 then north along that meridian to its intersection with the parallel of latitude 39°10ʹ10.56ʺS
5 east along that parallel to its intersection with the meridian of longitude 148°09ʹ07.20ʺE
6 then north along that meridian to its intersection with the parallel of latitude 39°08ʹ56.40ʺS
7 then west along that parallel to its intersection with the meridian of longitude 148°06ʹ28.80ʺE
