BASS STRAIT CENTRAL ZONE SCALLOP FISHERY (CLOSURE) DIRECTION 2017

The AUSTRALIAN FISHERIES MANAGEMENT AUTHORITY makes the following Direction under subsection 41A(2) of the Fisheries Management Act 1991.

Citation

1. This Direction may be cited as the Bass Strait Central Zone Scallop Fishery (Closure) Direction 2017.

Commencement

1. This Direction commences the day after it is registered on the Federal Register of Legislation.

Cessation

3.  This Direction ceases to have effect as if it was repealed on 31 December 2017 unless earlier revoked.

Interpretation

4.  Terms used in this Direction that are defined for the purposes of the Bass Strait Central Zone Scallop Fishery Management Plan 2002 (the Plan) have the same meanings in this Direction as they have in the Plan.

[Note: Terms defined in the Fisheries Management Act 1991 have the same meanings in this Direction.]

To Whom This Direction Applies

5.  This Direction applies to a holder of a fishing concession in the Bass Strait Central Zone Scallop Fishery and to a person acting on behalf of the holder.

[Note: This means that the Direction does not apply to a person if the person is fishing in the area of the Fishery in accordance with a fishing concession that is subject to another plan of management in force under the Act, under a scientific permit, a permit issued in another fishery, or under a licence issued under a law of a State or Territory.]

Direction Not to Engage in Fishing

6.  Fishing is not to be engaged in in the following areas of the Bass Strait Central Zone Scallop Fishery:

Apollo Bay Beds 1-4

The area of the Apollo Bay Beds 1-4 is the part of the Australian Fishing Zone contained within and bounded by a line:

i.commencing at the point of intersection of latitude 144^o05.196’ south, longitude 39^o7.542’ east and running progressively;

ii.then south along that meridian to its intersection with the parallel of latitude 39^o08.466’ south;

iii.then west along that parallel to its intersection with the meridian of longitude 144^o03.912’ east;

iv.then south along that meridian to its intersection with the parallel of latitude 39^o09.996’ south;

v.east along that parallel to its intersection with the meridian of longitude 144^o05.196’ east;

vi.then south along that meridian to its intersection with the parallel of latitude 39^o10.542’ south;

vii.east along that parallel to its intersection with the meridian of longitude 144^o08.682’ east;

viii.then north along that meridian to its intersection with the parallel of latitude 39^o08.884’ south;

ix.east along that parallel to its intersection with the meridian of longitude 144^o09.798’ east;

x.then north along that meridian to its intersection with the parallel of latitude 39^o07.542’ south;

xi.then west along that parallel to the point of commencement.

Flinders Island Beds 1-4

The area of the Flinders Island Beds 1-4 is the part of the Australian Fishing Zone contained within and bounded by a line:

i.commencing at the point of intersection of latitude 148^o03.00’ south, longitude 39^o11.40’east and running progressively;

ii.then south along that meridian to its intersection with the parallel of latitude 39^o19.80’ south;

iii.east along that parallel to its intersection with the meridian of longitude 148^o07.80’ east;

iv.then north along that meridian to its intersection with the parallel of latitude 39^o10.176’ south;

v.east along that parallel to its intersection with the meridian of longitude 148^o09.12’ east;

vi.then north along that meridian to its intersection with the parallel of latitude 39^o08.94 south;

vii.then west along that parallel to its intersection with the meridian of longitude 148^o06.48’ east

viii.then south along that meridian to its intersection with the parallel of latitude 39^o10.176’ south;

ix.then west along that parallel to its intersection with the meridian of longitude 148^o05.142’ east

x.then south along that meridian to its intersection with the parallel of latitude 39^o11.40’ south;

xi.then west along that parallel to the point of commencement.
