the recuest was that the prosecutor has no rlght

be brought to the Full E g h Court.

In Point's case

the Court unanimously refused

to disturb 'datson's

case.

The taxpayer had falled before a Justlce

of the

Hlgh Court. As

an alternative to seekmg to +peal

from hls declslon, he sought from the

justice the

statement of a case pursuant o s.198 of the Income Tax

Assessment Act 1936-1966.

Sub-section (1) thereof

provlded thet the Court mlght,

if it thought fit, state

a case in wrlting for the opinlon of the

Hlgh Court

upon any questlon

of law arlslng on the appeal. The

court referred to was either the

khgh Court (as con-

stltuted by a single Justice)

or the Susreme Court

of a

State simllarly constituted, see

s.157'.

The view was

apparently taken In Polnz's case that a

Justice before

whom a matter came pursuant

o s.196 was also entitled

to state a case pursuant

t o s.198.

In Polnt counsel endeevoured

to argue that an

appeel lay against the unwillingness

of the Justice to

state a case. Barwlck

C . J .

said (p.120):

against the unwlllingness of the justlce

to ste-ce

a case for the oplnlon of the Full Court.

It was

But, in truth, there could

be no appllcatlon in the proper use

of

that term. He made no order. The appellant

had no rlght to have a case stated, nor hsd

the Justice any duty under the statute to

do

so.

The statute affords, in

In my opinlon, no appeal

agamst his lack of

any desire to seek such assistance can

be brought.

Therefore, quite apart from the declslon

Watson's case (supra), In my oplnion an appeal

based on the fact that the

Justice did not wlsh

to state a case would

be incompetent."

The judgment of Barwick C.J. was agreed in by the other

members of the Court.

The words of the then existing

s.196 of the Income

Tax Assessment Act are not coucned

m quite the same

language as sub-sec.25(6) of this Court's Act.

In

particular the words, "if

It thinks fit" do not appear

therein. But the sectlon

1 s expressed so as to glve

the Court constltutea

by a single Judge a wlde dlscretlon

as to whether to state

a c2se o r reserve any questlon.

In my opinion the dlffereme in the wordlng of r;ne two provlslons is not materlal.

Sub-section 25(6) is a general provlsion relating

to all matters which are before a single

Judge of the

that it 1 s convenlent to refer a questlon, perhaps

because it raises unusual dlfficulties
