I, the Governor, acting under the Marine and Harbours Act 1981 section 9 and with the advice and consent of the Executive Council, vest in the Minister for Transport constituted under section 8(1) of that Act the land and water set out in the following Schedule. (In each case, the Deposited Plans, Lands and Surveys Diagrams, Plans and Town Lots referred to in the descriptions are held by the Western Australian Land Information Authority established by the Land Information Authority Act 2006.).

Given under my hand and the Public Seal of the State on 22 December 2010.

All that portion of sea bed known as Lot 3570 on Deposited Plan 64836, Reserve 50376 in Qualified

Certificate of Crown Land Title Volume LR3013 Folio 631.

PORT WALCOTT PORT AREA

All that portion of sea bed bounded by lines starting from the High Water Mark of the Indian Ocean at the northernmost northern extremity of Dolphin Island and extending easterly to the High Water Mark at the southernmost southern extremity of Legendre Island; thence easterly to the High Water Mark at the northernmost northern extremity of Delambre Island; thence south-easterly to a position 20 degrees 28 minutes South latitude, 117 degrees 10 minutes East longitude; thence easterly to a position 20 degrees 28 minutes South latitude, 117 degrees 17 minutes East longitude; thence south to a position 20 degrees 30 minutes .9 seconds South latitude, 117 degrees 17 minutes East longitude; thence south-easterly to a position 20 degrees 36 minutes .9 seconds South latitude, 117 degrees 31 minutes .6 seconds East longitude; thence south to the intersection of the High Water Mark of the Indian Ocean and thence 117 degrees 31 minutes.6 seconds East meridian of longitude; thence generally south-westerly, generally north-westerly, generally north-easterly and again generally south-westerly, again generally north-easterly and generally westerly along that mark to the northernmost north-western extremity of Burrup Peninsula; thence north-easterly crossing the western entrance to Searipple Passage to the High Water Mark at the westernmost south-western extremity of Dolphin Island and thence generally easterly, generally north-easterly, generally south- westerly and again generally north-easterly along that mark to the starting point (including the beds of all those navigable portions of rivers and creeks abutting the area) and excluding De Witt Locations 66 (Special Lease 3116/4624), 67 (Special Lease 3116/4625), 69 (Special Lease 3116/4628), and that part of Locations 63 (Special Lease 3116/4622), 65 (Special Lease 3116/4623), 68 (Special Lease 3116/4629), 106 (Special Lease 3116/4622) and 119 (Special Lease 3116/7394) below the High Water Mark.
