BARRISTERS' BOARD AMENDMENT RULES 1990

Made by the Barristers' Board under section 6.
Citation

1.These rules may be cited as the Barristers' Board Amendment Rules 1990.

103 (a), (b) or (c) "; and

Principal rules
2. In these rules the Barristers' Board Rules 1949* are referred to as the
principal rules.

Rule 103 amended

3.Rule 103 of the principal rules is amended by deleting the full stop after

paragraph (c) and inserting a semi-colon and the following paragraph—

(d) the employer of the certificated practitioner. ".

Rule 104 amended

4.Rule 104 of the principal rules is amended—

(a) by inserting after the rule designation "104." the sub-rule designation

"(1)";

(b) by deleting "103" and substituting the following-

(c) by inserting the following sub-rule—

(2) In respect of any financial year, a certificated practitioner shall not share costs under rule 103 (d) to an extent that exceeds the sum of—

(a) the practitioner's salary for that financial year;
(b) the direct costs incurred by the employer in connection with

the employment of the practitioner in that financial year; and

(c) the reasonable expenses incurred by the employer in running

the practitioner's office in that financial year. ".

Rule 107 inserted

5. After rule 106 of the principal rules the following rule is inserted—

"Employer" includes a related corporation

107. Where a certificated practitioner is employed by a corporation a reference in this Part to the employer of the practitioner includes a reference to a corporation that is deemed to be related to the employer by virtue of section 7 (5) of the Companies (Western Australia) Code. ".
