s1 3 s5 Barristers’ Admission Amendment (No. 1) No. 348, 1995 ˙ Short title 1. This rule may be cited as the Barristers’ Admission Amendment Rule (No. 1) 1995 . ˙ Rules amended 2. This rule amends the Barristers’ Admission Rules 1975 . ˙ Amendment of r 2 (Interpretation) 3.(1) Rule 2, heading— omit, insert— Definitions ’. (2) Rule 2, definitions “form” and “the old rules” omit. (3) Rule 2— insert— “approved form” means a form approved by the Board.’. (4) Rule 2(b)— omit. ˙ Replacement of r 3 (Repeal) 4. Rule 3— omit, insert— ˙ Approved forms 3. The Board may approve forms for use under these rules.’. ˙ Insertion of new rr 14A and 14B 5. Part 3— insert—
s6 4 s6 Barristers’ Admission Amendment (No. 1) No. 348, 1995 ˙ Definitions 14A. In this part— “admitting authority” means— (a) for Queensland—the Board and Judges; or (b) for another State—the entity responsible for admitting lawyers to practice in the State. “core subjects” means the subjects in a State approved, by the admitting authority for the State, as providing a person with an understanding of, and competence in, the areas of knowledge mentioned in schedule 2. “recognised academic course” means an academic course at a tertiary institution in a State (whether or not leading to a degree in law) that— (a) includes the equivalent of at least 3 years full-time study of law; and (b) has been approved, by the admitting authority for the State, as providing a sufficient academic qualification to practise law. ˙ Approval of core subjects and courses 14B.(1) This rule applies to the admitting authority for Queensland. (2) The authority may approve a subject to be a core subject for these rules if it is satisfied the subject provides a person who completes it with an understanding of, and competence in, an area of knowledge mentioned in schedule 2. (3) The authority may, under subrule (2), approve 2 or more subjects to be (if they are all completed) core subjects for an area of knowledge. (4) The authority may approve an academic course to be a recognised academic course for these rules if it is satisfied the course provides a person completing it with a sufficient academic qualification to practise law.’. ˙ Amendment of r 15 6.(1) Rule 15(d)(2)— omit, insert—
s7 5 s9 Barristers’ Admission Amendment (No. 1) No. 348, 1995 ‘(ii) the person has— (A) completed a recognised academic course; and (B) for the areas of knowledge mentioned in schedule 2—completed core subjects for the areas (whether or not as part of a recognised academic course) or otherwise satisfied the Board the person has an understanding of, and competence in, the areas; and (C) completed the requirements for stage 6.’. (2) Rule 15(d)(7)— omit. ˙ Omission of r 16 7. Rule 16— omit. ˙ Amendment of r 17 (Condition precedent to admission of barristers—Form 1) 8.(1) Rule 17, heading, ‘—Form 1.’— omit. (2) Rule 17, ‘in Form 1’— omit . ˙ Amendment of r 24 (Examination standards) 9.(1) Rule 24, after ‘report’— insert— ‘, in the approved form,’. (2) Rule 24, ‘in Form 2a’— omit.

(2) Rule 34, ‘in Form 8’— omit . ˙ Amendment of r 38 16.(1) Rule 38(a) and (b), ‘in Form 9’— omit, insert— ‘in the approved form’. (2) Rule 38(c), ‘in Form 1’— omit. (3) Rule 38(d)— omit, insert— ‘(d) if the person has previously been admitted to practice as a lawyer, whether in Queensland or another jurisdiction—give the Board details about the previous admission including, for example, the court in which the person has previously been admitted and the date of the previous admission.’. ˙ Amendment of r 39 17. Rule 39(1), ‘in Form 1’— omit. ˙ Amendment of r 41 18. Rule 41, ‘in Form 1’— omit, insert— ‘ of the Board given to the applicant under rule 39’.

Rule 54(1)— omit, insert— (1) A notice of an appeal must be made in the approved form.’. ˙ Replacement of r 57 26. Rule 57— omit, insert— ˙ Numbering and renumbering of rules 57. In the next reprint of these rules produced under the Reprints Act1992 , the provisions of these rules must be numbered and renumbered as permitted by the Reprints Act 1992 .’. ˙ Insertion of new r 59 27. After rule 58— insert— ˙ Application for admission before 1 January 1998 59.(1) This section applies to a person who applies for admission before 1 January 1998. (2) The person may be admitted as a barrister if the person could have been admitted under these rules if rule 15 was not amended by the Barristers’ Admission Amendment Rule (No. 1) 1995 or any later amendment. (3) This section expires on 1 January 1999.’.
