Barley Research (Levy Collection) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Barley Research Levy Collection Act 1980.

1. Amendment

1.1 The Barley Research (Levy Collection) Regulations are amended as set out in these Regulations.

2.Regulation 2 (Interpretation)

2.1 Definition of "authorized agent":

After "his", insert "or her".

2.2 Definition of "quarter":

Omit the definition, substitute:

"'quarter' has the same meaning as in section 5 of the Act;".

2.3 Definition of "Department":

Omit the definition.

2.4 Definition of "Secretary":

Omit the definition, substitute:

"'Secretary' means the Secretary to the Department;".

2.5 Definition of "the Act":

Omit the definition, substitute:

" 'the Act' means the Barley Research Levy Collection Act 1980".

3.Regulation 3 (Manner of payment of leyy, &c.)

3.1 Omit the regulation, substitute:

Payment of levy

"3. (1) For the purposes of subsection 5(1) of the Act, the period of 28 days is prescribed.

"(2) Levy and other amounts payable to the Commonwealth under the Act must be paid to the Collector of Public Moneys at the office of the Department in Canberra.".

4.Regulation 5 (Return to be furnished by growers of barley)

4.1 Subregulation 5(1):

After "he" (wherever occurring), insert "or she".

5.Regulation 6 (Execution and lodgement of returns)

5.1 Subparagraph 6 (a) (i):

Omit "his", substitute "the person's".

5.2 Paragraph 6 (b):

Omit the paragraph, substitute:

"(b) must be lodged at the office of the Department in Canberra within 28 days after the end of the quarter to which it relates.".

6.Regulation 7 (Authorized agent)

6.1 Subregulation 7 (1):

After "his", insert "or her".

7.Regulation 8 (Proper records to be kept)

7.1 Paragraph 8(l)(c):

After "he", insert "or she".

7.2 Subregulation 8 (2):

After "he", insert "or she".

7.3 Subregulation 8 (3):

After "he", insert "or she".

7.4 Paragraph 8 (3) (a):

After "him", insert "or her".

7.5 Subregulation 8 (4):

After "he", insert "or she".

8. Schedule

8.1 Omit "Dated this day of 1980." (wherever occurring), substitute "Dated 19.".

8.2 After "his", insert "or her".
