(Amendment No 8)

1     Name of plan

This plan is Bankstown Local Environmental Plan 2001 (Amendment

No 8).

2     Aims of plan

This plan aims:

(a)

to rezone the land to which this plan applies to Zone 2 (a)—Residential A under Bankstown Local Environmental Plan 2001, and

(b)

to ensure consent will not be granted to residential development until Bankstown City Council (as consent authority) is satisfied that an acceptable level of amenity is maintained to the land by noise mitigation measures that minimise the impact of noise and vibration on any current or future residents in the locality, and

(c)

to ensure consent will not be granted to residential development until the consent authority:

(i)

considers whether the land is contaminated, and

(ii)

if contaminated, considers whether the land is suitable in its contaminated state for residential development, and

(iii)

if it considers that the land is to be remediated to a level suitable for residential development, is satisfied that the land has been remediated to that level.

3     Land to which plan applies

This plan applies to land situated in the City of Bankstown, being Lot 101, DP 771594, and known as 64 Johnston Road, Bass Hill, as shown edged heavy black on the map marked “Bankstown Local Environmental Plan 2001 (Amendment No 8)” deposited in the office of Bankstown City Council.
