under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Bankstown Local Environmental Plan 2001

(Amendment No 15).

2      Aims of plan

The aims of this plan are:

(a)

to rezone the land to which this plan applies to Zone 2 (a)— Residential A under Bankstown Local Environmental Plan 2001, and

(b)

to ensure that consent will not be granted to residential development of the land until the consent authority (that is, Bankstown City Council) is satisfied that an acceptable level of amenity is maintained in relation to the land by noise mitigation measures that minimise the impact of rail noise and vibration on any current or future residents in the locality.

3      Land to which plan applies

This plan applies to land situated in the City of Bankstown, being Lot 1, DP 504700, and known as 82 Allum Street, Yagoona, as shown coloured pink on the map marked “Bankstown Local Environmental Plan 2001 (Amendment No 15)” deposited in the office of Bankstown City Council.

4      Amendment of Bankstown Local Environmental Plan 2001

Bankstown Local Environmental Plan 2001 is amended as set out in

Schedule 1.

The consent authority must be satisfied that noise

mitigation measures to control rail noise have been

incorporated into the development so that the development

complies with AS/NZS 2107:2000, Acoustics—

Recommended design sound levels and reverberation times

for building interiors and the rail noise criteria set out in

Chapter 163 of the Environment Protection Authority’s

publication titled Environmental Noise Control Manual.
