GLEESON CJ:   This appeal was heard in Canberra on 26 April 2005 by a Court constituted by Justices McHugh, Gummow, Hayne, Callinan and myself.  On 7 September 2005 the Court made orders allowing the appeal.  The Court now orders by consent that order 3 be amended by adding the words “and the costs of the respondent of the appeal to the Court of Appeal of the Supreme Court of New South Wales”.

I publish that amended order.
