Bankruptcy Rules2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Rules under the Bankruptcy Act 1966.

Commencement

1. These Rules commence on 3 January 1989.

Trustee may appoint person to vote at a meeting of creditors

2.Rule 71 of the Bankruptcy Rules is amended by omitting “first”.

Repeal of rule 92

3. Rule 92 of the Bankruptcy Rules is repealed.

Summoning meetings of creditors

4. Rule 93 of the Bankruptcy Rules is amended:

(a) by omitting “, not being the first meeting of the creditors,”;

(b) by adding “or she” after “he”.

Repeal of rules 94 and 177

5.Rules 94 and 177 of the Bankruptcy Rules are repealed.

Schedule 1

6.Schedule 1 to the Bankruptcy Rules is amended by omitting Form 56.

 

Application

7. Rules 71, 92, 93, 94 and 177 of, and the Schedule to, the Bankruptcy Rules as in force immediately before the commencement of these Rules continue to apply to a bankruptcy in respect of which the date of bankruptcy occurred before the commencement of these Rules.
