RULES UNDER THE BANKRUPTCY ACT 1966.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Rules under the Bankruptcy Act 1966.

Amendments of the Bankruptcy Rules 

Modifications of the Actin relation to administrations under Part XI.

1. Rule 90 of the Bankruptcy Rules is amended by omitting paragraph (j) and substituting the following paragraph:—

“(j) section 122 of the Act is modified by omitting sub-section (1) and substituting the following sub-section:—

‘(1) Where a person who administers the estate of a deceased person in respect of which an order has been made under Part XI, after the presentation of the petition on which the order was made—

(a) executes a conveyance or transfer of property or a charge on property;

(b) makes a payment; or

(c) incurs a liability on behalf of the estate,

having the effect of giving a creditor of the estate a preference, priority or advantage over other creditors of the estate, the conveyance, transfer, charge, payment or obligation is void as against the trustee of the estate.’.”.

Fees and percentages payable to the official receiver.

2. Rule 182 of the Bankruptcy Rules is amended by inserting after sub-rule (1) the following sub-rule:—

“(1a) Where the official receiver acts as trustee of the estate of a bankrupt or as trustee of the estate of a deceased person in respect of whose estate an order for administration has been made under Part XI of the Act, the official receiver shall be paid in respect of a matter specified in an item in Schedule 5 the fee specified in that item.”.

Inspections of documents.

3. Rule 200 of the Bankruptcy Rules is amended—

(a) by omitting from sub-rule (1) all words after the word “may,” and substituting the words “subject to sub-rule 179 (1) and to sub-rule (3), inspect any document filed in connexion with a proceeding or in relation to a debtor”; and

(b) by omitting from sub-rule (2) the words “the next succeeding sub-rule” and substituting the word and figure “sub-rule (3)”.

Schedules 4 and 5.

4. The Fourth Schedule to the Bankruptcy Rules is repealed and the following Schedules substituted:—

Transitional.

6. Notwithstanding the amendment effected by rule 4, the fee payable in respect of the matter specified in item 2 of Schedule 4, or item 2 or 4 of

Schedule 5, to the Bankruptcy Rules as amended by that rule in connexion with the estate—

(a). of a person who became a bankrupt before the commencement of these Rules; or

(b). of a deceased person in respect of which an order has been made under Part XI of the Act before the commencement of these Rules,

shall be the fee that would have been payable in respect of that matter under the Bankruptcy Rules if that amendment had not been effected.
