Banking (Statistics) Regulations2 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulations under the Banking Act 1959.

1.   Commencement

1.1   These regulations commence on 1 July 1998.

2.   Amendment

2.1   The Banking (Statistics) Regulations are amended as set out in these regulations.

3.   Regulation 2 (Definitions)

3.1   Definitions of accounting day and the Act:

Omit the definitions, substitute:

“accounting day, for an ADI, means the day fixed under regulation 3 by APRA for the ADI.

Act means the Banking Act 1959.”.

4.   Regulation 3 (Accounting days)

4.1   Omit “The Reserve Bank:”, substitute “APRA:”.

4.2   Paragraph 3 (a):

Omit “a bank”, substitute “an ADI”.

4.3   Paragraph 3 (b):

Omit “bank”, substitute “ADI”.

5.   Regulation 4 (Balance sheets)

5.1   Subregulation 4 (1):

Omit “a bank, other than a foreign bank,”, substitute “an ADI, except a foreign ADI,”.

5.2   Paragraph 4 (2) (a):

Omit “the bank’s”, substitute “the ADI’s”.

5.3   Paragraph 4 (2) (b):

Omit “the Reserve Bank”, substitute “APRA”.

6.   Regulation 5 (Statements of profit and loss)

6.1   Subregulation 5 (1):

Omit “a bank, other than a foreign bank,”, substitute “an ADI, except a foreign ADI,”.

6.2   Paragraph 5 (2) (a):

Omit “the bank’s”, substitute “the ADI’s”.

6.3   Paragraph 5 (2) (b):

Omit “the Reserve Bank”, substitute “APRA”.

7.1   Subregulation 6 (1):

8.1   Subregulation 7 (1):

Omit “The Reserve Bank”, substitute “APRA”.

9.   Regulation 9 (APRA to publish balance sheets etc)

9.1   Subregulation 9 (1):

Omit “the Reserve Bank is to prepare and publish, for each bank:”, substitute “APRA must prepare and publish for each ADI:”.

9.2   Subregulation 9 (2):

Omit the subregulation, substitute:

 “(2) However, if APRA is not given relevant accounts, financial reports or other information in relation to the banking business of an ADI, APRA is not required to prepare and publish a balance sheet, profit and loss statement or statement of assets and liabilities for the ADI.”.
