Exemption (paragraph 8(1)(a)) (29/06/1990)

Reserve Bank of Australia in pursuance of Regulation 38 of the Banking (Foreign Exchange) Regulations hereby:

1.revokes the exemption dated 21 June 1984 relating to sub-regulation 8(1)(a) of the Regulations;

2.exempts from the application of sub-regulation 8(1)(a) of the Regulations a person who makes any payment in Australia to, by the order of, or on behalf of a person who is not a resident or places any sum in Australia to the credit of any such person.

This instrument shall come into operation on 1 July 1990.

The Banking (Foreign Exchange) Regulations 1959 – Exemption (paragraph 8(1)(a)) (29/06/1990) was varied by the Banking (Foreign Exchange) Regulations 1959 – Revocation of Variation of Exemption and Variation of Exemption (paragraph 8(1)(a)) (17/10/2001), as varied by the Banking (Foreign Exchange) Regulations 1959 – Direction relating to foreign currency transactions and to the Federal Republic of Yugoslavia – Amendment of the Annex and Variation of Exemption – Amendment to the Annex (04/10/2007).

The variations, as amended, have not been incorporated in this compilation.

BANKING (FOREIGN EXCHANGE) REGULATIONS

REVOCATION OF VARIATION OF EXEMPTION AND
VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations hereby revokes the Variation of Exemption dated 22 December 1995 in the form published in the Commonwealth of Australia Gazette No. GN 1, 10 January 1996, relating to sub-regulation 8(1)(a) of the Regulations.

The Reserve Bank of Australia pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations hereby varies the Exemption dated 29 June 1990 relating to sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to a person who makes any payment in Australia by the order of, or on behalf of:

(i)       the Embassy of the Federal Republic of Yugoslavia; or

(ii)      the Consulate‑General of the Federal Republic of Yugoslavia; or

(iii)     Narodna Banka Jugoslavije (including Banque Nationale de Yugoslavie),

or who makes any payment in Australia to, by the order of, or on behalf of any person listed in the Annex to this variation of exemption, or who places any sum in Australia to the credit of any person listed in the Annex to this variation of exemption.

For the persons referred to in paragraphs (i), (ii) and (iii) above, this variation of exemption applies to any payment which exceeds a value equivalent to A$100,000.

All such payments and credits require the specific prior approval of the Reserve Bank of Australia.  Please refer applications for approval to the Manager, Market Analysis, International Department of the Reserve Bank in Sydney.

The revocation and variation contained in this instrument respectively come into operation on 17 October 2001.

VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations 1959 hereby varies the Exemption dated 29 June 1990 relating to sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to a person who makes any payment in Australia to, by the order of, or on behalf of any person listed in the Annex to this variation of exemption, or who places any sum in Australia to the credit of such persons.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date of publication of the amendment in the Commonwealth of Australia Gazette.

This instrument comes into operation on 25 November 2002.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations 1959 hereby varies the Exemption dated 29 June 1990 relating to sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to a person who makes any payment in Australia to, by the order of, or on behalf of any person listed in the Annex to this variation of exemption, or who places any sum in Australia to the credit of such persons.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 19 September 2006.

The Banking (Foreign Exchange) Regulations 1959 – Exemption (paragraph 8(1)(a)) (29/06/1990)  was varied by the Banking (Foreign Exchange) Regulations 1959 – Variation of Exemption relating to paragraph 8(1)(a) – Burma (18/10/2007), as varied by the Banking (Foreign Exchange) Regulations 1959 – Direction relating to foreign currency transactions and to Burma – Amendment to the Annex and Variation of Exemptions – Amendment to the Annexes (16/10/2008).

The variation, as amended, has not been incorporated in this compilation.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia, pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations 1959, hereby varies the Exemption dated 29 June 1990 relating to sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to a person who makes any payment in Australia to, by the order of, or on behalf of any person listed in the Annex to this variation of exemption, or who places any sum in Australia to the credit of such persons.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 24 October 2007.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia, pursuant to sub‑regulation 38(2) of the Banking (Foreign Exchange) Regulations 1959, hereby varies the Exemption dated 29 June 1990 relating to sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to a person who makes any payment in Australia to, by the order of, or on behalf of any person or entity listed in the Annex to this variation of exemption, or who places any sum in Australia to the credit of such persons or entities.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 15 October 2008.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia, pursuant to sub-regulation 38(2) of the Banking (Foreign Exchange) Regulations 1959, hereby varies the Exemption dated 29 June 1990 relating to
sub-regulation 8(1)(a) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments directly or indirectly to, or for the benefit of any person listed in the Annex to this variation of exemption.

The Annex to this variation of exemption may be amended from time to time. Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 22 June 2011.
