AN ACT to Consolidate the Law relating to Bank

Holidays.

[Assented to 29th April, 1970.]

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

This Act may be cited as the Bank Holidays

Short title.

(1) The Acts mentioned in the First Schedule

to this Act to the extent therein expressed to be

repealed are hereby repealed accordingly.

(2) The provisions of sections fifteen and sixteen

of the Interpretation Act, 1918, apply in respect of

the repeals effected by subsection (1) of this section

but the express application of those provisions does not exclude the application of the other provisions of that Act, to this Act.

Subject to this Act, the several days specified in the Second Schedule to this Act shall be kept as close holidays in and by all banks in the State and such days are hereinafter in this Act called bank holidays.

will be carried out for keeping all banks in the State open for business until five o'clock on the afternoon of every Friday that is not a bank holiday.

(3) If after a proclamation has been made pur- suant to subsection (1) of this section, the Governor is satisfied that the arrangements referred to in subsection (2) of this section have ceased to operate the Governor may, by proclamation, declare that as from a day specified in the proclamation Saturday shall cease to be a bank holiday.

This section does not apply to any agency of

(2) Any day so appointed shall be kept as a close holiday in and by all banks in the locality specified in the proclamation.

(3) When a proclamation is made pursuant to subsection (1) of this section, the Governor may, from time to time, vary or cancel it by subsequent proclamation published in the Government Gazette at least one week before the day appointed a special day to be observed as a bank holiday in the former proclamation.

6.(1) The Governor may, from time to time, by ra=gt. to

bank holiday, in any year by or under this Act shall ff, dayk

not be a bank holiday for that year, and may Ogn'Ton,

appoint another day to be a bank holiday instead, s '-

and the day so appointed shall be a bank holiday

(2) A proclamation made under subsection (1) of this section shall be published in the Gazette at least one week before the day declared in the pro- clamation not to be a bank holiday in any year.

Saturday (subject to subsection (3) of Section 4 of this Act).

Anniversary of the Birthday of the reigning Sovereign.

Christmas Day.

The following days when week days

New Years Day.

The twenty-sixth day of December.

When either of the two lastmentioned days falls upon a Sunday, the next following Monday there- after shall be a bank holiday.

Anniversary of the Foundation of the settlement of Aus-

tralia (Foundation Day (26th January) ).

Labour Day (1st March).

Anniversary of the Foundation of the Colony (1st June).

When any of the three lastmentioned bank holidays falls upon any day other than a Monday, the next fol- lowing Monday thereafter shall be a bank holiday instead of such day.
