REASONS FOR DECISION TO DISMISS OBJECTION APPLICATION

  1. On 10 February 2010, the Government party gave notice under s 29 of the Native Title Act 1993 (Cth) of its intention to grant exploration licence E04/1973 (the proposed tenement) to Regalpoint Exploration Ltd (the grantee party) and included in the notice a statement that it considered the grant attracted the expedited procedure.

  2. On 27 May 2010 Banjo Wurrunmurra & Others on behalf of the Bunuba People (WC99/19) (the native title party) made an expedited procedure objection application in relation to the proposed tenement.

  3. On 6 December 2011 the Department of Mines and Petroleum on behalf of the Government party advised the Tribunal that the grantee party’s application for the proposed tenement was withdrawn.

Decision

  1. The objection application WO10/688 is dismissed pursuant to s 148(a) of the Native Title Act 1993 (Cth).
