s1 2 s4 Banana Industry Protection Amendment (No. 1) No. 164, 1998 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Banana Industry Protection Amendment Regulation (No. 1) 1998 . ˙ Definitions 2. In this regulation— “order” means the order in council made under the Act and gazetted on 22 April 1989 at page 2391. “regulation” means the Banana Industry Protection Regulation 1989 . PART 2—AMENDMENT OF REGULATION ˙ Regulation amended 3. This part amends the regulation. ˙ Omission of s 3 (Fees) 4. Section 3— omit.

s5 3 s8 Banana Industry Protection Amendment (No. 1) No. 164, 1998 ˙ Insertion of new s 6 5. After section 5 as relocated by this regulation— insert— ˙ ‘ Repeals ‘ 6.(1) All subordinate legislation made under the Act, other than this regulation, is repealed. ‘ (2) This section expires the day after it commences.’. PART 3—AMENDMENT AND RELOCATION OF ORDER ˙ Amendment and relocation of order 6. This part amends the order and relocates certain of its provisions to the regulation. ˙ Amendment of s 1 7.(1) Section 1, as heading— insert— ‘ Levy of assessment ’. (2) Section 1, ‘3 cents’— omit, insert— ‘4c’. ˙ Amendment of s 2 8. Section 2, as heading— insert— ‘ Weight of fruit ’.

(3) Section 3, from ‘Director-General’ to ‘Brisbane’— omit, insert— ‘chief executive’. ˙ Relocation of provisions 10.
