AN ACT to amend the Banana Industry

Compensation Trust Fund Act, 1961-1973.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Banana	Short title
and citation.

(3) The principal Act as amended by this Act may be cited as the Banana Industry Compensation Trust Fund Act, 1961-1975.

ment. 2. This Act shall come into operation on a day

to be fixed by proclamation.

Section. 5

amended. 3. Section 5 of the principal Act is amended

(a) by deleting the interpretation of the term "case" and substituting a new interpreta- tion as follows

"carton" means a container having a sixteen kilogram capacity when used for the packing and marketing of bananas; ; and

(b) as to the interpretation of the term "wholesaler", by deleting the words "fifty cases", in line three of paragraph (c) of that interpretation, and substituting the words "one hundred cartons".

Section 19

amended. 4. Section 19 of the principal Act is amended,

as to subsection (2)—

(a)	by deleting the word "fifteen", in lines two and three of that subsection and again in line seven, and substituting the word "fourteen";
(b)	by deleting the word "case", in line three and again in line six, and substituting the word "carton"; and
(c)	by deleting the words "the quantity contained in a case", in line ten, and substituting the words "sixteen kilograms".

Section 25

5.Section 25 of the principal Act is amended— amended. (a) as to subsection (3)-

(i)    by deleting the word "cases", in line three of that subsection and again in line eleven, and substituting the word "cartons"; and

(ii)    by deleting the words "one dollar fifty cents per case", in lines eight and nine, and substituting the words "one dollar thirty cents per carton"; and

(b) as to subsection (4), by deleting the word "cases", in line three of that subsection and again in line four and line nine, and substituting the word "cartons".

Section 27

6. Section 27 of the principal Act is amended amended.

(a) as to subsection (1)-

(i)    by deleting the passage "4 000 square metres", in line nine of paragraph (b) of that subsection, and substi- tuting the words "one hectare"; and

(ii)    by deleting the words "one acre", in line twelve of that paragraph, and substituting the words "that area"; and

(b) as to subsection (4), by inserting after the words "one thousand", in lines nine and ten of that subsection, the words "four hundred".

7. Section 29 of the principal Act is amended. em.̀ n i od'le

substituting the word "twenty-one".

S. Section 41 of the principal Act is amended amended.

by deleting the word "fourteen", in line two, and

substituting the word "twenty-one".
