COMPENSATION TRUST

FUND.

No. 16 of 1969.

AN ACT to amend the Banana Industry Compensa-

tion Trust Fund Act, 1961-1964.

[Assented to 6th May, 1969.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Banana

(2) In this Act the Banana Industry Compensa- tion Trust Fund Act, 1961-1964, is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Banana Industry Compensation Trust Fund Act, 1961-1969.

Amendment

to a. 5.

2.

Section five of the principal Act is amended

by substituting for the interpretation "case" an

interpretation as follows:

"case" means a bushel container used for

packing bananas; .

3. Section seven of the principal Act is

amended

(a) as to subsection (2)-

(i)    by substituting for the word "three", in line one, the word "four"; and

(ii)    by substituting for paragraph (c) a paragraph as follows:

(c)

subject to paragraph (b) of subsection (3) of this section, two shall be persons who are growers and are elected by the growers for appointment by the Governor as such members to be and act as the repre- sentatives of the growers. ;

(b) as to subsection (3)-

(i)  by substituting for the word "member", in line one of paragraph (a), the word "members";

(ii)   by substituting for paragraph (b) a paragraph as follows:

Until the first election of the elective members pursuant to paragraph (a) of this sub- section and their appointment by the Governor as members of the Committee, the offices of those members shall be

filled by persons who are growers and are nominated by the Minister, and those persons shall be appointed by the Governor to be and act as members of the Committee until the elective members are elected to those offices.

; and

(iii) by substituting for the word "member", in line two of paragraph (c), the word "members"; and

as to subsection (4), by substituting for

(c)

the word "two", in line one the word "three".

4. Section fourteen of the principal Act is

by repealing and re-enacting subsection (3) as follows:

(3) A question arising at a meeting shall be determined by a majority of the valid votes of the members or deputies present.

; and

(b) by repealing subsection (4).

5. Section nineteen of the principal Act is

amended as to subsection (2) by substituting for the words "two shillings", in lines two and three and in line seven, in both cases the words "fifteen cents".

6. Section twenty-five of the principal Act is amended, as to subsection (3), by substituting for the words "twenty shillings", in line eight, the words "one dollar fifty cents".

Amendment

to S. 27.

7. Section twenty-seven of the principal Act is

amended

(a)

as to subsection (3), by substituting for the word "A", in line one, the passage "Subject to subsection (3a) of this section, a"; and

(b)

by adding after the subsection (3) a subsection as follows:

(3a) Where a grower has bananas in course of production on his land in plantings of different ages, whether the plantings are adjoining or not, he is entitled to be paid compensa- tion in respect of the loss suffered by him on each such planting as if that planting contained the total quantity of bananas in course of production on his land at the time of the loss. .

8. Section twenty-nine of the principal Act is

amended, as to subsection (1), by substituting for

the word "seven", in line two, the word "fourteen".

to s. 41.

9. Section forty-one of the principal Act is amended by substituting for the word "seven", in line two, the word "fourteen".
