AN ACT to amend the Banana Industry Com-

pensation Trust Fund Act, 1961.

[Assented to 4th November, 1964.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Banana Moir:iatti:m.

Industry Compensation Trust Fund Act Amend-

ment Act, 1964.

(2) In this Act the Banana Industry

Compensation Trust Fund Act, 1961, is referred to

as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Banana Industry Compensation Trust Fund Act, 1961-1964.

2. Section twenty-five of the principal Act is amended by deleting the passage, ", but subject to subsection (3) of section twenty-seven of this Act" in lines four and five of paragraph (b) of sub- section (3).

one of subsection (1), the words, "claims to be".

Section twenty-seven of the principal Act is

amended by repealing subsection (3) and substitut-

ing the following subsection

(3) A grower is entitled to be paid compen- sation under this Act only in respect of so much of the loss suffered by him as exceeds twenty per centum of the value of the total quantity of bananas in course of production on his land at the time of the loss, and in any case shall himself bear the whole of that loss if it does not exceed twenty per centum of that value, or so much of the loss as is equal to twenty per centum of that value if the loss exceeds that percentage. .
