The following local environmental plan is made by the local plan-making authority under the
Environmental Planning and Assessment Act 1979.

1 Name of Plan
This Plan is Ballina Local Environmental Plan 2012 (Amendment No 39).
2 Commencement
This Plan commences on the day on which it is published on the NSW legislation website.
3 Land to which Plan applies
This Plan applies to land to which Ballina Local Environmental Plan 2012 (the
principal Plan) applies and, in particular, to the following:
| (a) | land at Barlows Road, West Ballina, being Lot 137, DP 858896 (being land that, immediately before the making of this Plan, was land identified as deferred matter under the principal Plan (deferred matter)), |
| (b) | certain land adjoining Emigrant Creek, |
| (c) | land at Pimlico Road, Pimlico, (being land that was deferred matter immediately before the making of this Plan), |
| (d) | certain land at Tara Downs, Lennox Head, |
| (e) | land at 44–52 Blue Seas Parade, Lennox Head, being Lot 1, DP 1165957, |
| (f) | land at Blue Seas Parade road reserve, Lennox Head, |
| (g) | land with frontage to North Creek Road, Lennox Head and adjacent land with frontage to Fieldcrest Place, Lennox Head, |
| (h) | land at 140 North Creek Road, Lennox Head, being Lot 233, DP 1104071, |
(i) land within the Hutley Drive road reserve, Hutley Drive South, Lennox Head (being land that was deferred matter immediately before the making of this Plan),
| (j) | open space land at the intersection of North Creek Road and Castle Drive, Lennox Head, |
| (k) | land at 2 Skinner Street, Ballina, being lot 10, DP 1126929, |
| (l) | land adjacent to Liffey Avenue and Lindsay Avenue, Cumbalum, |
| (m) | land with frontage to Chilcott Circuit, Kemp Street and O’Rourke Street, Cumbalum, |
| (n) | land at the intersection of Richmond Street and Swamp Street, Wardell and land in that vicinity with frontage to Richmond Street, Swamp Street and the Richmond River, |
| (o) | land at Newports Lane, Uralba (being land that was deferred matter immediately before the making of this Plan). |
4 Maps
The maps adopted by Ballina Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the local plan-making authority on the making of this Plan.
