I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Ballina Local Environmental Plan 2012 (Amendment No 31).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the following land:

(a)

land at Boeing Avenue, Ballina, being part of Lot 952, DP 1165266 and part of Lots 2–5, DP 123781,

(b)

land at Paperbark Close and Teven Road, West Ballina, being Lots 2 and 3, DP 749680, Lot 5, DP 1031875, Lots 227–229, DP 1121079 and Lot 12, DP 1011575.

4      Maps

The maps adopted by Ballina Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.

5      Amendment of Ballina Local Environmental Plan 2012

Schedule 1 Additional permitted uses

Omit “Area D” from clause 4 (1). Insert instead “Area H”.

Schedule 1

Insert at the end of the Schedule:

6      Use of certain land at Boeing Avenue, Ballina

(1)

This clause applies to land at Boeing Avenue, Ballina, being part of Lot 952, DP 1165266 and part of Lots 2–5, DP 123781 and identified as “Area F” on the Additional Permitted Uses Map.

(2)

Development for the purposes of a bulky goods premises is permitted

with development consent.
