I, the Minister for Planning, make the following local environmental plan under the

Environmental Planning and Assessment Act 1979.

1      Name of Plan

This Plan is Ballina Local Environmental Plan 2012 (Amendment No 26).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land to which Ballina Local Environmental Plan 2012 applies, including the following land:

(a)

certain land in the Ballina Heights Estate (Lot 237, DP 1117692 and Lots 1 and 2, SP 85843, Foley Avenue, Lot 389, DP 1199596, Liffey Avenue and part of Lot 390, DP 1199596, Unara Parkway) and certain land in Tamarind Drive (including Lot 2, DP 1208439), Cumbalum,

(b)

land that, immediately before the commencement of this Plan, was identified as deferred matter under Ballina Local Environmental Plan 2012, being:

(i)	part of Lots 4 and 5, DP 1197191 and adjoining council road reserves, Ballina Lighthouse, East Ballina, and
(ii)	part of the Blue Seas Parade road reserve, Lennox Head, and

(iii)	part of the Tuckean Nature Reserve, Meerschaum Vale, and
(iv)	certain land in Broken Head Road, Newrybar, and
(v)	Lot 101, DP 1212282, Bolwarra Circuit, Wollongbar.

(c)

Lots 26–33, DP 1168665, Blue Seas Parade, Lennox Head,

(d)

certain land fronting or near Cooper Close and Fig Tree Hill Drive, Lennox Head,

(e)

part of Lot 2, DP 1074242, part of Lot 47, DP 1148641 and part of Lot 153, DP 1216009, Elkhorn Parade, North Ballina,

(f)

Lot 308, DP 1211326 and adjoining council road reserves, Morton Way, Skennars Head,

(g)

Lot 42, DP 262103, Wollongbar Public School, Simpson Avenue, Wollongbar.

4      Maps

The maps adopted by Ballina Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.
